HR Updates For 2024

Here are the key employment law changes in the UK for 2024:

This year brings a wave of employment law changes that HR teams need to prepare for.

Holiday Pay and Annual Leave

From 1 April 2024, employers can pay atypical workers like zero-hours staff a rolled-up holiday pay of 12.07% of their earnings each pay period, instead of calculating based on hours worked.

This simplifies holiday pay calculations for irregular hours workers.

Workers can carry over annual leave if unable to take it due to family leave or sickness. Any untaken leave after sick leave must be taken within 18 months.

Redundancy Protection

From 6 April 2024, employers must offer suitable alternative employment to pregnant employees, those who recently had a miscarriage, and those on family leave (maternity, adoption, shared parental) for up to 18 months after the expected week of childbirth or placement.

Sexual Harassment

From October 2024, employers must take reasonable steps to prevent sexual harassment of employees. Tribunals can increase compensation by 25% if employers breach this new duty.

Flexible Working

From 6 April 2024, employees gain the right to request flexible working from day one of employment (currently after 26 weeks). They can make two requests per year, and employers must respond within 2 months (currently 3).

Predictable Working Patterns

From October 2024, workers with unpredictable hours can request more predictable terms like fixed working hours/days from their employer.

Carer’s Leave

From 6 April 2024, employees get 1 week of unpaid carer’s leave per year for a dependent with long-term care needs.

Paternity Leave

From 8 March 2024, fathers/partners can take paternity leave in 1 or 2 non-consecutive 1-week blocks within 52 weeks of birth.

TUPE Consultations

From 1 July 2024, businesses with <50 employees or transferring <10 staff can consult employees directly instead of collective consultation for TUPE transfers.
